Terms of Use
Last updated: September 19, 2026
These Terms of Use (“Terms”) govern your access to and use of the KISS mobile application, website, and related services (collectively, the “Services”) provided by KISS APP INC (“KISS,” “we,” “us,” or “our”). By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
1. Eligibility
You must be at least 18 years old and legally capable of entering into these Terms. You may use the Services only in compliance with applicable law.
2. Educational and organizational service
KISS provides educational information and tools for organizing sexual-health information, encounters, reminders, and partner notifications. KISS does not provide medical diagnosis, treatment, emergency services, or legal advice, and it does not replace a qualified healthcare professional. Seek professional care for symptoms, testing, treatment, medication, or urgent concerns.
3. Accounts and security
You are responsible for providing accurate account information, maintaining the confidentiality of your login credentials, and promptly notifying KISS if you suspect unauthorized access. You are responsible for activity conducted through your account unless prohibited by law.
4. User-provided information
Information entered into KISS—including encounter details, test information, partner connections, and notes—may be self-reported. You are responsible for the information you submit and for having any permission required to submit it. Do not use the Services to impersonate another person, submit knowingly false health information, harass someone, or facilitate unlawful, exploitative, or non-consensual conduct.
5. Partner notifications
KISS may allow users to send or trigger anonymous partner notifications. Notifications are intended to encourage awareness, testing, and appropriate care. KISS does not independently verify every self-reported result or guarantee that a notification will be delivered, opened, understood, or acted upon. The Services do not replace any disclosure or reporting obligation that may apply under law or medical guidance.
6. Acceptable use
You may not misuse the Services, attempt unauthorized access, interfere with security or operation, reverse engineer the Services except where law permits, upload malicious code, scrape data, exploit another person, or use KISS for harassment, fraud, discrimination, or illegal activity. We may investigate suspected misuse and restrict or terminate access when reasonably necessary to protect users, KISS, or others.
7. Subscriptions and purchases
Some features may require a paid subscription or in-app purchase. Pricing, renewal, cancellation, and refund terms are displayed through the applicable app marketplace at purchase. Transactions processed by Apple App Store or Google Play are also governed by that marketplace’s terms. Unless required by law, KISS cannot issue refunds for purchases controlled by a third-party marketplace.
8. Intellectual property
The Services, KISS name and branding, software, designs, and original content are owned by or licensed to KISS and are protected by applicable intellectual-property laws. KISS grants you a limited, personal, revocable, non-exclusive, non-transferable license to use the Services for their intended purpose.
9. Third-party services and links
The Services may link to or interact with third-party services, healthcare resources, app marketplaces, or websites. KISS does not control and is not responsible for third-party content, availability, privacy practices, or services. A link does not constitute an endorsement.
10. Service changes and availability
We may modify, suspend, or discontinue features; correct errors; or update the Services. We do not guarantee uninterrupted, error-free, or completely secure operation. Features described as planned, upcoming, or in development are not guaranteed to launch on a particular date.
11. Disclaimers
To the fullest extent permitted by law, the Services are provided “as is” and “as available.” KISS disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability. Nothing in these Terms excludes warranties that cannot lawfully be excluded.
12. Limitation of liability
To the fullest extent permitted by law, KISS and its directors, officers, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of data, loss of profits, or harm resulting from reliance on user-provided information, notification delivery, or third-party services. Any limitation applies only to the extent permitted by applicable law.
13. Termination
You may stop using KISS at any time. We may suspend or terminate access for material violation of these Terms, risk to users or the Services, suspected unlawful activity, or as otherwise permitted by law. Provisions that by their nature should survive termination will survive.
14. Changes to these Terms
We may update these Terms as the Services or law changes. We will post the revised version and update the date above. When required, we will provide additional notice or request consent.
15. Governing law
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.
